Putenikhin, activist of the Other Russia, was detained because of absence of Moscow registration

One of the reasons for the arrest of Dmitry Putenikhin, an activist of the Other Russia, who splashed water in the prosecutor's face, has been a lack of his registration in the Russian capital. This was reported by Ekaterina Ilyina, Spokesperson of the Tver District Court of Moscow.

"The Code of Criminal Procedure considers an absence of permanent residence in the territory of the Russian Federation to be one of the circumstances allowing a pre-trial restriction to a suspect in the form of custody," Ekaterina Ilyina told the "Caucasian Knot" correspondent.

Let us remind you that on October 28 Dmitry Putenikhin splashed water in the face of Prosecutor Alexei Smirnov, who represented the state prosecution at the trial on the riots in Manege Square in Moscow. On November 1, the Tver Court had sanctioned two-month custody of Dmitry Putenikhin.

According to the ruling of Elena Stashina, Judge of the Tver District Court of Moscow, the Court took into account an aggravating circumstance that Dmitry Putenikhin "had been earlier prosecuted for the crime against the constitutional order and the state security, he has no permanent working place and no official earnings for his living."

On this basis, Judge made a conclusion that, being free, Dmitry Putenikhin "could escape from the bodies of preliminary investigation and the trial, to continue criminal activity and to threaten the victim and witnesses."

However, according to Svetlana Sidorkina, the activist's lawyer, in this particular case, the court considered the case in too formal way. The lawyer represents the defendant's interests on the initiative of the interregional human rights association "AGORA".

"The registration can be confirmed not only by the stamp in the passport, but also by the extract from the house register or the certificate in the form of No. 3, which also indicates the registration place," Svetlana Sidorkina has emphasized.

According to the lawyer, the court dismissed the defence's motion to interrogate the witnesses - his civil wife and the journalist, who together with the activist participated in political activity, - who could clarify the Dmitry Putenikhin's status.

The lawyer has noted that now she prepares a complaint against the court decision.
