Activist of "The Other Russia" litigates militia in Rostov

On February 13, the Rostov Regional Court will consider the cassation complaint filed by the activist of "The Other Russia" Pavel Nagibin on violation of the right to freedom, freedom of movement and freedom of creativity.

Earlier, the Pervomaiskiy Court of Rostov-on-Don rejected the complaint of the Rostov citizen against the actions of militiamen who had prevented Pavel Nagibin's and his wife's participation on September 8, 2007, in the exhibition of painter Vladimir De dated to primaries of the united candidate of the opposition from the Rostov Region. Then, the primaries failed, and all the participants of Vladimir De's art project "Heroes of Our Time" were detained by the militia.

"The OVD (Interior Department) of the Azov District had illegally detained me with the aim not to admit me to the presentation of Vladimir De's art project, which is a breach of my right to the freedom of creativity and participation in the cultural life by depriving me of my freedom and restricting my freedom of movement (Articles 44, 27 and 22). Based on the aforesaid I demand to oblige the OVDs of Azov and Azov Region to eliminate the admitted violations of my rights," Pavel Nagibin's complaint runs.

On December 28, 2007, the Pervomaiskiy District Court rejected the complaint having stated that Mr Nagibin had failed to prove the violations of his rights. The OVD of the Azov District sent a document to the court running that the applicant was neither detained nor brought there within the specified period.
