At trial on events of October 2005 in Nalchik, prosecution discloses the case

On Thursday, at the session of the Supreme Court of Kabardino-Balkaria on the events on October 13, 2005, the accusation party started disclosing the materials of the criminal case related to the episode named "Landysh" (Lily of the Valley).

This early procedure was caused by non-appearance of prosecution witnesses in the courtroom. Thus, on Thursday, none of them came.

Presiding Judge Galina Gorislavskaya read a certificate saying that one of the witnesses, an OMON fighter, summoned for today, is at in-patient treatment at hospital because of a gunshot wound; the second witness changed his residence. The prosecution has agreed to wait till recovery of the former; as to the latter, it has put forward a petition to search him and bring to the trial.

Then, the court passed over to consideration of the materials of the criminal case.

The accusation party announced protocols of examination of the place of the incident - a country house located in "Landysh" settlement, from where, according to the version of the prosecution, at night of October 13, 2005, an attack was prepared on the building of the UBOP (Department to Fight Organized Crime) of the Kabardino-Balkarian MIA.

The protocols describe the country house and the adjoining land plot and list the revealed exhibits, namely, sub-machine guns, ordinances, a grenade launcher, grenades, canisters with ammonium nitrate and their detailed description, religious books "Moslem's Fortress" and "From Life of Prophets", foodstuffs, bottles from alcoholic beverages and mineral water, medicines, anaesthetic preparations and syringes.

In the course of announcing the protocols, the defence raised a question about the witnesses, who were present in the course of withdrawal of these exhibits. The prosecution answered that because of the warfare taking place at that time in the city, it was dangerous to bring civilians to the summer cottage; therefore, the confiscation was made without witnesses.

Defendant Shavaev drew attention of the court to the fact that no shells were found in the territory, which evidences that the people did not use their firearms there.

Then, the defendants have stated that the above protocols were not among the case materials presented to them and their advocates; therefore, they had no chance to read them and get ready for the defence and asked to postpone the session till Monday. The prosecution has objected, saying that they were not obliged to present anything to anybody; and the order of announcing documents is up to them.

The court has satisfied the defendants' petition.
