Apti and Aishat Magmadov's defenders file complaint to ECtHR

Defenders of Apti and Aishat Magmadov asks the European Court of Human Rights (ECtHR) to recognize the verdict of the Moscow Regional Court and all subsequent decisions against the convicted persons as not complying with the requirements of the European Convention. This was reported by lawyer Musa Khadisov.

On December 26, 2011, the Moscow Regional Court sentenced Apti Magmadov to 6 and Aishat Magmadov to 2 year of imprisonment at common security colony on charges of contributing terrorism and creation of illegal armed formations (IAFs). On January 18, Aishat was released, after that the defenders filed an appeal. The Supreme Court of the Russian Federation has twice considered appeals of lawyers against the verdict of the Moscow Regional Court and dismissed them.

According to Musa Khadisov, in regard to Apti and Aishat Magmadov, provision of Article 6 of the European Convention for the Protection of Rights and Fundamental Freedoms, concerning the right to a fair trial and investigation into a criminal case, was violated.

"The Article states that each person, against whom any criminal charge was filed, has the right to a fair public trial within a reasonable time held by an independent and impartial tribunal," emphasized the lawyer.

Musa Khadisov believes that the actions of Apti and Aishat Magmadov contain no components, and he demands a fair consideration of the case.
