ECtHR obliges Russia to pay 6500 euros to each of Gubashev brothers

The European Court of Human Rights (ECtHR) has satisfied the complaints of the defence of Anzor and Shagid Gubashev about their custody conditions at the SIZO (pre-trial prison) and about late considerations of their appeals lodged in the case of Boris Nemtsov's murder, the advocate of Anzor Gubashev has stated today.

Boris Nemtsov was killed on February 27, 2015, in Moscow. The defendants in his murder case are Zaur Dadaev, brothers Anzor and Shagid Gubashev, Tamerlan Eskerkhanov and Khamzat Bakhaev. Investigators consider Ruslan Mukhudinov, the driver of Ruslan Geremeev, to be both the customer and the organizer of the murder; Geremeev himself figures in the case as a witness.

The "Caucasian Knot" has reported that in December 2016 it became known that all the defendants in Boris Nemtsov's murder case had complained to the ECtHR about Moscow courts and custody conditions at the SIZO.

As reported today by Musa Khadisov, the advocate of Anzor Gubashev, the ECtHR has obliged the Russian government to pay 13,000 euros of compensation to Anzor and Shagid.

According to the advocate, the defence had complained about the violation of Articles 5 (right to liberty and security) and 8 (right to respect for private and family life) of the European Convention on Human Rights and Fundamental Freedoms (ECHR), the "Interfax" writes.

"The ECtHR has satisfied our complaints and awarded the compensation to the Gubashev brothers of 6500 euros each. We had complained about the custody conditions, namely, about delays in delivery to the court, violations of the catering regime, use of handcuffs, and failures of the court to timely consider our appeal complaints," the TASS quotes Mr Khadisov as saying today.
