Gubashevs’ defence refutes data about ECtHR’s decision in their favour

The complaints of Anzor and Shagid Gubashev about their custody conditions and delays in consideration of their appeals in Boris Nemtsov’s murder case were accepted by the European Court of Human Rights (ECtHR), but it has made no decisions on payment compensations to the brothers, said their advocate.

Boris Nemtsov was killed on February 27, 2015, in Moscow. The defendants in his murder case are Zaur Dadaev, brothers Anzor and Shagid Gubashev, Tamerlan Eskerkhanov and Khamzat Bakhaev. Investigators consider Ruslan Mukhudinov, the driver of Ruslan Geremeev, to be both the customer and the organizer of the murder; Geremeev himself figures in the case as a witness.

The “Caucasian Knot” has reported that on January 30, news was reported, with reference to Musa Khadisov, an advocate of the Gubashev brothers, that the ECtHR had upheld his clients’ complaints and awarded 6500 euro to each of them.

The information about the awarded payments was refuted by Musa Khadisov himself in his conversation with the "Caucasian Knot" correspondent. Mr Khadisov has explained that the complaints were only accepted by the ECtHR as "considered acceptable." However, no decision was made on compensations, the advocate has stressed. He said that a mistake occurred in the translation of the document received from the ECtHR.
