Lawyers recognize decision of Russian CC on Noe Mskhiladze's complaint as fateful for stateless persons
The decision of the Constitutional Court (CC) of Russia on the complaint filed by Noe Mskhiladze, a native of Georgia, will help to release stateless persons kept in special detention centres. This was stated by advocates Olga Tseitlina and Marina Dubrovina, who noted that earlier, Russian courts completely ignored the rights of stateless persons.
The "Caucasian Knot" has reported that the Russian CC recognized the need to release citizens who are subject to expulsion from the Russian Federation, but who do not have the opportunity to fulfil that decision.
The resolution on the Noe Mskhiladze's complaint "is a major breakthrough in the protection of rights not only for stateless persons, but also for citizens of unrecognized countries who have long been kept in detention centres." This was said by Olga Tseitlina, an advocate for the network "Migration Rights" of the Human Rights Centre "Memorial".
According to her, Noe Mskhiladze is now 45 years old. In 1988, he came to Russia from Georgia. Since 1988, Noe Mskhiladze lived in Saint Petersburg, but he did not exchange his Soviet passport for a passport of the Russian Federation.
The advocate notes that Georgia "refused to accept Noe Mskhiladze, since he left the country before the recognition of its independence."
For two years, Noe Mskhiladze has been kept at a temporary detention centre for foreign citizens in Saint Petersburg. Meanwhile, in the case of Roman Kim, another stateless person, supported by the European Court of Human Rights (ECtHR), "the authorities of the Russian Federation did not take any measures."
The advocate has also added that the defence of Noe Mskhiladze appealed to the ECtHR for compensation for moral and material harm.
Marina Dubrovina, an advocate of the human rights organization "Agora", has reported that she represents the interests of Nedim Khalilov, a resident of Crimea, another stateless person. The native of Uzbekistan has been kept for a year in detention centres of the Krasnodar Territory.
