Complaint in the case of Dagestanis killed in Chechnya sent to ECtHR

Human rights defenders have complained to the European Court of Human Rights (ECtHR) about an inefficient inquiry into the case of the eight young people, who disappeared in Dagestan and were declared killed in a shootout in Chechnya.

The "Caucasian Knot" has reported that on August 12, the Russian Supreme Court (SC) refused to transfer the consideration of the case of the above Dagestanis from Chechnya to another Russian region. According to Chechen law enforcers, the young men had been preparing a terror act and were killed in a shootout. Their mothers feared that a court in Chechnya would not be able to objectively investigate the case, and witnesses thereof would be afraid to come to the trial.

The human rights organizations "International Agora" and "Legal Initiative" have filed a complaint with the ECtHR about a violation of the right to life, the prohibition of torture and an effective remedy within the case of the persons who went missing in Dagestan, the "RosBiznesConsulting" (RBC) reports.

"We are invited to believe that the young people kidnapped themselves, and then staged an armed raid to the neighbouring republic for committing terror acts there," Andrei Sabinin, an "Agora" lawyer, has stated.

Let us remind you that Gashim Uzdanov, Pakhrudin Makhaev, Islam Magomedov and Shamil Djamalutdinov disappeared on the way to Makhachkala on September 28, 2016. On October 4 of the same year, Gusein Guseinov, Klych Klychev, Shamil Djamalutdinov and Kamil Djamalutdinov disappeared in Khasavyurt.

  • Compensation decrease for illegal prosecution violates rights of KBR resident

The court ruling, which awarded Madin Gubzhokov compensation of 30,000 roubles for unlawful criminal prosecution, is incomparable with the moral harm caused by the actions of Azamat Kyaov, a former law enforcer. The amount is ridiculous and should be appealed against, lawyers and human rights defenders have stated.
