ECtHR not to consider complaint filed by activists from Nakhichevan

The European Court of Human Rights (ECtHR) excluded a complaint filed by activists Malakhat Nasibova and Ilgar Nasibov from cases under consideration. The plaintiffs accepted the offer of the Azerbaijan's authorities on an amicable agreement and 17,000 euros in compensation.

Journalist Malakhat Nasibova, who migrated from Azerbaijan, complained about pressure in connection with her work for the NGO "Resource Centre for Human Rights and Democracy Development" in 2007.

On December 7, 2007, law enforcers destroyed an office of the "Resource Centre for Human Rights and Democracy Development" in Nakhichevan. The incident occurred after an arrest of Ilgar Nasibov, a reporter of the Radio Liberty. A policeman accused the journalist of insulting his honour and dignity, and the court sentenced Ilgar Nasibov to 90 days of imprisonment.

A complaint was filed to the ECtHR in connection with the search and confiscations at the office of the "Resource Centre for Human Rights and Democracy Development" and at an apartment of the Nasibov spouses in Nakhichevan. Meanwhile, a lawsuit on defamation and insult was filed against the Malakhat Nasibova's husband.

Khalid Agaliev, a lawyer from the Institute of Media Rights, believes that the claims of the Nasibov spouses "would inevitably be granted." According to the lawyer, the authorities of Azerbaijan proposed an amicable agreement, since otherwise the ECtHR could have appointed a larger monetary compensation.

"The government has begun to propose amicable agreements more often, apparently to demonstrate, on the one hand, its disposition to cooperate with the ECtHR, and on the other hand, to demonstrate that it had not been allegedly involved in cases against activists and journalists," Khalid Agaliev said.
