ECtHR awards EUR 60,000 to sister of KBR resident killed by law enforcers

Policemen had poorly prepared the operation to detain Khyzyr Begiev in Nalchik, and just shot the suspect dead, the European Court of Human Rights (ECtHR) has concluded.

The "Caucasian Knot" has reported that Khyzyr Begiev, a resident of the Kabardino-Balkarian Republic (KBR), was killed in Nalchik on April 18, 2014. According to investigators, he opened fire on policemen and was shot dead in response. In August 2016, the court posthumously found Begiev guilty of illegal arms dealing and encroachment on lives of law enforcers.

Begiev's relatives claimed that he had nothing to do with the armed underground and was an active fighter against drug dealers in the KBR.

According to investigators, when Begiev saw a car with law enforcers, he tried to get away from them in his car, but crashed into an embankment and ran towards the forest. Then, he was shot dead. The ECtHR has pointed to the circumstances that raise doubts that Begiev tried to abscond from justice. Policemen should have foreseen that Begiev would try to escape, since they had treated him as a dangerous and armed criminal, but this came as a surprise to them, the ECtHR has noted.
