Chechen contract soldier from Chechnya loses case on dismissal for refusing to go to Ukraine

In Grozny, the garrison military court refused to reinstate contract soldier Magomed Elemkhanov, who was dismissed after he failed to comply with the order to leave “for a trip to perform service and combat missions.”

Magomed Elemkhanov, a contract soldier from Chechnya, did not succeed in challenging his early dismissal due to his refusal to go to Ukraine, the “Kavkaz.Realii”* reports.

Magomed Elemkhanov appealed to the court with a request to invalidate the order of the commander of the unit dated May 23 “on the application of a disciplinary sanction in the form of early dismissal from military service due to non-fulfilment of the terms of the contract.” The contract soldier also asked the court to reinstate him in the service and provide him with all types of allowance for the period between his dismissal from service and reinstatement.

The lawyer of Magomed Elemkhanov explains that his client “did not violate the terms of the contract and conscientiously performed his official duties.” However, the representative of the military unit said that the contract soldier refused to perform his duties and was dismissed for that.
