Person with disability from Dagestan denied compensation for participation in SMO
A court refused to award compensation to Nuradil Bagautdinov, a person with disability from Dagestan, for being mobilized and sent to the special military operation zone in Ukraine without a medical examination.
Nuradil Bagautdinov was mobilized in September 2022. The man provided the draft commission with documents confirming his disability and serious illness, but the commission did not accept them. Nuradil Bagautdinov also sent appeals to the military commissar of Dagestan, but that did not help, the “Kavkaz.Realii”* reported.
A week after being drafted for the military service, Nuradil Bagautdinov was sent to the special military operation (SMO) zone; and he received leave for rehabilitation and passing a medical commission a month later. The resident of Dagestan was transferred to the military unit’s permanent deployment location, and it took several months from military officials to prepare the documents for his dismissal from the military service.
Nuradil Bagautdinov filed a lawsuit to the court, in which he requested three million roubles from the Russian Ministry of Defence (MoD) as compensation for moral damages for unjustified military draft. The Makhachkala Garrison Court and the Southern District Military Court denied Nuradil Bagautdinov’s claim. The courts referred to the missed deadlines for filing a claim, although Nuradil Bagautdinov was serving at the military unit at that time.
