Court denies compensation to KBR convict for HIV infection

The Oktiabrsky District Court of Novorossiysk has dismissed Yuri Mikhailov's lawsuit for compensation for the fact that after staying in jails in Novorossiysk and in the Kabardino-Balkarian Republic (KBR), he was infected with HIV and hepatitis. This was reported by his advocate, Svetlana Toreeva.

Yuri Mikhailov demanded compensation for inadequate custody conditions. He said that with his diseases it was very difficult for him to work in forced labour, including at a construction site. He could not refuse working; otherwise it would be treated as a non-compliance with the conditions and he would be sent back to the colony.

The "Caucasian Knot" has reported that Mikhailov asked the court to replace his indicted forced labour with a more lenient punishment. The Elista City Court in Kalmykia would not satisfy this claim, but Mikhailov filed an appeal and achieved a mitigation of the verdict down to four years of restricted freedom.
