Lawyers criticize amendments about military contracts for defendants

New laws signed by President Vladimir Putin have given defendants the chance to sign a contract with the Russian Ministry of Defence. Earlier, only persons under investigation or convicts could do the above. The new laws violate the rights of victims who will not be able to obtain justice in court, lawyers note. According to them, participants of the shooting neat an office of the “Wildberries” Company who are under investigation may also be sent to the special military operation zone.

On September 24, the Russian State Duma adopted a law on the possibility of exempting a person from criminal liability at the trial stage in case if the person wants to sign a contract with the Russian Ministry of Defence (MoD) and go to the special military operation zone (SMO).

On October 9, Ramzan Kadyrov, while speaking about the conflict around the Wildberries Company, mentioned Suleiman Kerimov, Senator from Dagestan, and Russian State Duma MPs, Bekkhan Barakhoev and Rizvan Kurbanov. He called on them to prove their non-involvement in ordering his murder and warned of his readiness to declare a blood feud against them. For more details about the conflict, watch the video.

Advocate Timofei Shirokov reports that the essence of the new law is that it has become possible for such a category as defendants to sign a contract with the Russian Ministry of Defence. Earlier, military contracts were allowed to be signed by persons under investigation and by convicts.

Advocate Valery Shukhardin claims that the new law is unconstitutional. “The rights and interests of all participants in a trial, including victims, are essentially ignored. A defendant may go to the SMO, there is no court’s decision, and all the rights of the victims go to hell,” the advocate said.

The advocate has suggested that there will be many defendants accused of minor crimes who will sign contracts with the Russian MoD.

In his Telegram channel, Chechen leader Ramzan Kadyrov wrote that offenders would be sent to the SMO, including those who “allow themselves to park anywhere, drive under the influence of illegal drugs, violate traffic rules, and provoke conflicts.”
