Russian Supreme Court refuses to consider Chechen advocate Idalov’s appeal
The Supreme Court of the Russian Federation has refused to consider the appeal lodged by advocate Timur Idalov to institute criminal proceedings against Lyudmila Fedorchenko, a judge of the Khimki City Court.
The “Caucasian Knot” has reported that on January 21, advocate Timur Idalov was released from compulsory labour. The advocate requested the Russian Supreme Court (SC) to institute criminal proceedings against the judge who sentenced him. The Timur Idalov’s appeal against the sentence was received by the court on January 16. Under the appeal, Timur Idalov was released from punishment in the case on threats to kill or cause harm to humanhealth against the public prosecutor due to the expiration of the statute of limitations. Timur Idalov was also released from deprivation of his status as an advocate.
On November 28, 2024, a court sentenced Timur Idalov to one year and eleven months of compulsory labour and banned him from practicing law for three years, finding him guilty of threatening the public prosecutor. The court unreasonably left Timur Idalov in custody pending appeal, although the defendant was to be immediately released. On December 27, 2024, Timur Idalov was released and appealed to a judge of the Khimki City Court, pointing out the violations in his case.
According to the Timur Idalov’s appeal, Judge Lyudmila Fedorchenko allowed his arbitrary deprivation of liberty, despite the imposition of a sentence not related to deprivation of liberty.
Timur Idalov intends to seek to bring judges to responsibility for unjust decisions.
“The Russian laws do not allow those sentenced to compulsorylabour to be held in custody. However, officials made an exception for advocate Timur Idalov, since I am not pleasing to people who abuse their powers,” the advocate claimed.
