The district court in Tuapse denied the head of the local investigative department a motion to overturn the decision to terminate the criminal case on the negligence of officials who refused to provide housing to the large family of Sergei Kartashov and Tatyana Pimenova.

In late June, Kartashov and Pimenova learned that a criminal case for negligence brought against unidentified officials in Tuapse who failed to comply with the court's decision and provide the family with housing was dismissed due to the absence of a criminal event.

On July 1, a court hearing was held on the initiative of the head of the Tuapse Investigative Department of the Investigative Committee of Russia for Krasnodar Krai, who petitioned to cancel the decision of his subordinate and actually asked to extend the investigation period of the criminal case under Article 293 of the Criminal Code of the Russian Federation (negligence). Instead of the head, investigator Bagdasarov himself came to the hearing and asked the court to cancel his own decision. The victims, Sergei Kartashov and Tatyana Pimenova, were also summoned to court, and came with five children.

According to the participants in the process, the hearing lasted about half an hour. The investigator motivated his request by the fact that he did not have time to complete the necessary investigative actions. However, the prosecutor objected, stating that "the grounds for continuing the investigation have disappeared," since the officials offered the family an apartment, although, in the opinion of the parents themselves, it was unsuitable for habitation.

Sergei Kartashov called what was happening a "ping-pong game" staged by the investigation and the court. "This is all a planned game. "The judge has put another fat point in our case. In fact, now we have neither the status of victims nor hope for housing. We are being offered to go the civil route, but we already had a court decision - and it was not executed properly," Tatiana Pimenova told a "Caucasian Knot" correspondent.

The judge, according to her, called what was happening "an outrage." During the hearing, according to Kartashov, the judge directly said: "This criminal case will not help you, go to a civil court."

The Tuapse residents intend to appeal the court's decisions within 15 days.

Lawyer Elena Pavlova, who does not represent the interests of the Pimenov family, called the actions of the investigation and the court "an absurd circle" and analyzed some of the actions of government officials. According to her, the way the investigator and his superiors handled the case does not indicate a real desire to investigate the negligence of officials, but an attempt to officially get rid of an inconvenient criminal case.

"In essence, because no one wants to deal with the rights of this family," she told a "Caucasian Knot" correspondent.

She emphasized that in this way the investigation shifts responsibility from itself to the court, and the court returns the case back, but without consequences. "This is a legal ping-pong game. The investigation pretends that it cannot complete the case without a trial, and the court pretends that it cannot interfere with the investigation. As a result, no one is held accountable, and the family is left without housing and without justice," the lawyer noted.

According to Elena Pavlova, the court's refusal effectively deprived the Pimenovs of the right to restore their status as victims and re-initiate the investigation. "Now they will tell us: "The court refused, which means everything is legal." Although there was no real verification of the officials' actions. "The injured party was left without protection," she added.
