Sentence of man convicted of murdering Aslan Kambiev overturned

The Supreme Court of Kabardino-Balkaria acquitted Ruslan Kudayev, who was found guilty of the death of athlete Aslan Kambiev.

As "Kavkazsky Uzel" reported, on February 24, the Nalchik City Court found resident of the village of Psygansu Ruslan Kudayev guilty in the case of the murder of the famous athlete Aslan Kambiev. Kudayev was found guilty under Article 108 of the Criminal Code of the Russian Federation (murder in excess of the limits of necessary defense) and released from punishment (1 year 10 months of restriction of freedom) due to the expiration of the statute of limitations for criminal prosecution. He was also cleared of the charge of illegal acquisition of firearms (Part 1 of Article 222 of the Criminal Code of the Russian Federation).

The Supreme Court of Kabardino-Balkaria fully acquitted Ruslan Kudayev in the case of the murder of Kambiev due to the lack of corpus delicti, the newspaper "Gazeta Yuga" reported late in the evening on July 1.

"The Supreme Court of the republic considered the appeals in a closed session - everyone who was not a participant in the process was removed from the courtroom," the publication says.

According to the case card on the court's website, the guilty verdict "was overturned and the case was dismissed." The basis for this decision is "incorrect application of the criminal law." The case was received by the court on April 21, the appellate court held three hearings: May 20, June 5, and June 26. At the last hearing, a decision was made on the case.

Recall that in April 2022, Aslan Kambiev's relatives complained to the head of the Investigative Committee of the Russian Federation for Kabardino-Balkaria that investigators had not taken the necessary actions and that the suspect was at large. After the start of the trial, the victims demanded that the accused be taken into custody, but the court found no grounds for this.
