Resident of Kabardino-Balkaria tries to prove judicially illegality of block-posts
The "Caucasian Knot" correspondent has learnt today that Ilyas Timishev, a resident of Kabardino-Balkaria, has applied to the Zamoskvoretskiy Court of Moscow with a demand to recognize the actions of the Ministry of Internal Affairs of the Russian Federation of setting up block-posts in Northern Caucasus to be illegal.
Mr Timishev, in particular, wrote in his application, that the Ministry of Internal Affairs of the Russian Federation "starting from January 1995, has established federal check points in the territory of the Republics of North Caucasus: the Chechen Republic, the Republic of Ingushetia, the Republic of Northern Ossetia-Alania and the Kabardino-Balkarian Republic," where, as he asserts, his constitutional rights are regularly breached. Thus, in order to get from Nalchik, where Ilyas Timishev is temporarily living as a forced migrant, to Grozny, one needs to pass 7-8 check points, at each of them presenting documents for examination to militiamen or internal troops militaries.
In Timishev's opinion, such checks are breaching his constitutional right of free travel within the country and put him into position of a suspect.
The court has found Mr Timishev's claims unjustified and rejected his complaint.
Ilyas Timishev has appealed against the decision of the Zamoskvoretskiy Court to the Judicial Board on Civil Cases of the Moscow City Court. The Board has upheld the decision and left the cassation complaint without satisfaction.
