Khasavyurt ex-policemen fail to receive due payments, lawyer Sapiyat Magomedova asserts

On May 24, lawyer Sapiyat Magomedova appealed to the Khasavyurt City Court to recognize inactivity of the Chief and the Chief Accountant of the Khasavyurt OVD (Interior Division), who failed to respond to her requests about cash payments to ex-policemen, dismissed from the structures of the Ministry of Internal Affairs (MIA) for health reasons, as unlawful. The lawyer believes that the ex-policemen do not receive due compensations in full.

Sapiyat Magomedova: we had to go to court to oblige officials to fulfil their duties

Sapiyat Magomedova represents interests of ten ex-policemen from the Khasavyurt OVD, Categories II and III invalids, who hired her in February 2012.

"According to the complainants, who served in the structures of internal affairs of Khasavyurt who were dismissed on limited state of health because of getting military trauma, the Accounting Division of the Khasavyurt OVD fails to fulfil correct calculations and payments of monthly cash compensations," states the lawyer's complaint filed to court.

According to the lawyer, ex-policemen pay attention to the fact that they had never (neither in period of their service, nor in period of their dismissal) put their signatures in any payment and account statements upon receipt of salaries and monthly compensation.

"They were asked to put their signatures in a writing book; so, (the ex-policemen, note of the "Caucasian Knot") suspect that the Accounting Division keeps "double" book-keeping," states the complaint.

To check correctness of the calculations, the lawyer sent a request to the Information Centre and the Financial Department of the MIA to the Chief and the Chief Accountant of the Khasavyurt OVD, asking to issue certified copies of salary statements and other documents, related to payments of compensations.

"When I received no answer, I sent new requests; however, no results followed," Sapiyat Magomedova told the "Caucasian Knot" correspondent.

"The MIA's officials demanded to present, in addition to the lawyer's warrant, letters of attorney from each of my clients. And I presented the letters of attorney. Then, the MIA's officials proposed me to contact the Khasavyurt OVD, and there, in turn, I was advised to contact the MIA," said Sapiyat Magomedova.

"I had to go to court to oblige the police officials to fulfil their duties," she stated.

Sapiyat Magomedova has also filed a complaint, addressed to Arsen Bulatov, Chief of the State Labour Inspectorate in Dagestan, and Andrei Nazarov, Prosecutor of Dagestan, asking to conduct a joint on-site inspection of compliance of the Khasavyurt OVD's leaders with labour legislation.

Besides, the lawyer asks to check the financial activities of the OVD's Accounting Division, correctness of payments to the policemen, dismissed from the MIA's structures because of handicaps suffered while on service.

The lawyer also asks to take measures to eliminate detected violations and restore violated rights of the ex-policemen, who got military traumas, paying them arrears of compensations.

"The recipients of money have the rights to know the calculation procedure. Such a mystery suggests concealment of the committed crime. The most interesting thing is that shortly after my requests, the OVD's Accounting Division started to invite my clients and offer them to get some money: 100,000 roubles, 60,000 roubles, and 80,000 roubles. Moreover, the OVD's Accounting Division failed to explain, what kind of compensations was represented by that amounts, and refused to transfer them to accounts at the Savings Bank," said the lawyer.

Ruslan Rasulov: families of policemen, killed while on service, left to mercy of fate

Representatives of the independent trade union of policemen and prosecutors of Dagestan believe that violation of the rights of ex-policemen is widespread.

"Irresponsibility of the MIA's management has led to the fact that hundreds of the OVD staff members, who were dismissed for health reasons and who got military traumas, and relatives of policemen, killed while on service, cannot get compensations, provided for by the federal legislation, in particular, by the Federal Law FZ-52 'On compulsory state insurance of military men and law enforcement agents'," stated Ruslan Rasulov, Deputy Chairman of the trade union.

According to Ruslan Rasulov, bankruptcy of the insurance company became a cause of violations of the rights of the ex-policemen from the OVD.

"The fact is that in 2011, our MIA signed the contract with the Joint-Stock Company (JSC) 'Insurance Company 'Rostra', located in Moscow, without checking the financial soundness of the company. As a result, the JSC "Rostra" turned bankrupt. Perhaps, that was done on purpose, by prior agreement with the MIA's management. And at present, about 200 staff members of the Dagestani police, dismissed for health reasons, and relatives of the killed policemen cannot get insurance compensations," said Ruslan Rasulov.

"Ex-policemen from the Khasavyurt OVD, who hired the lawyer, represent a tiny fraction of all victims, who are trying to somehow realize their rights. More than 30 persons appealed to me with similar complaints. And neither the MIA, nor the government of the republic and the country take any steps to help them. And the Prosecutor's Office fails to respond to that," stated Ruslan Rasulov.

Shamil Temirgereev: "double" book-keeping not in question

According to Shamil Temirgereev, Chief of the Khasavyurt OVD, no violations in the order of payments were committed in the OVD.

"Our Accounting Division is subjected to inspections, conducted three times a week; therefore, 'double' book-keeping is not in question," Shamil Temirgereev told the "Caucasian Knot" correspondent.
