Dagestani Prosecutor's Office checks reports on kidnappings of local residents: 6 persons found

As a result of checking the reports, including ones of the "Caucasian Knot", about kidnappings of Dagestani residents in the period of January 1-May 18, which involved armed men in camouflage and masks, whereabouts of 6 persons were revealed. Fate of 14 persons remains unknown. This was reported by the Dagestani Prosecutor's Office.

"The Prosecutor's Office checked complaints about kidnappings of 20 Dagestani residents. Kidnappers released 2 persons; 3 persons were detained and kept in custody for committing various crimes; one disappeared person was found dead," states the report of the Prosecutor's Office.

According to the Prosecutor's Office, following the results of consideration of reports on kidnappings, five criminal cases were instituted and investigated under Article 126 (kidnapping) of the Criminal Code of the Russian Federation, and three criminal cases under Article 105 (murder) of the Criminal Code of the Russian Federation.

The Prosecutor's Office mentioned cases, when checking of the reports on disappearance of citizens revealed that the disappeared persons were detained by law enforcement agencies or that they joined the illegal armed formations (IAFs).

The report, which was published on the website of the Dagestani Prosecutor's Office on May 30, lists in details 14 cases of kidnappings and disappearances of people in the republic.

Disappearance of Ali Ametov and Alan Apendiev

On March 19, Fatima Ametova, a resident of the village of Terekli-Mekteb of the Nogai District, appealed to the human rights organization "Mothers of Dagestan for Human Rights". She said that on March 5, her son Ali Ametov, born in 1984, and his relative Alan Apendiev, born in 1989, left the house for the mosque for evening prayers and never returned.

"During checking the complaints about disappearance of Ametov and Apendiev, two residents of the village of Terekli-Mekteb of the Nogai District, it was revealed that they joined the IAFs, and, on May 11, their bodies together with the bodies of other militants were found after special operation, conducted by law enforcement agencies in the village of Tsvetkovka of the Kizlyar District, after their rendering armed resistance while law enforcement agents tried to detain them," states the message of the Prosecutor's Office.

Disappearance of Rizvan Aliev and Muslimat Alieva

According to the Dagestani Prosecutor's Office, on April 29, Alibekova filed to the Operative Division of the Soviet District of the Department of the Russian Ministry of Internal Affairs (MIA) in Makhachkala the complaint about disappearance on April 25 of her children Rizvan Aliev and Muslimat Alieva. "Later, on May 3, 2012, brother and sister Aliev committed a double terror act on the GIBDD (road police) post in Makhachkala. Their involvement has been already revealed by investigators," stated the Prosecutor's Office.

Let us remind you that at that time, the first and the second explosions occurred at the "Alaska-30" police check point. The terror act killed 13 persons.

Till present, the position of relatives of brother and sister Aliev concerning accusations of power agents is unknown.

Kidnapping of Ramazan Saidkhanov and Jafar Khanmagomedov

On April 25, Abdulkhamid Saidkhanov reported that his brother Ramazan Saidkhanov was taken out of the house by armed men in masks and camouflage, who introduced themselves as staff members of the OVD (Interior Division) of the Magaramkent District. According to him, power agents conducted a search without witnesses, and found package with a magazine for a submachine gun and ball grenade did not belong to the detainee.

According to the Prosecutor's Office, it was revealed that Ramazan Saidkhanov was detained after the search of his house, where a grenade and round of 7.62 mm had been found. Criminal case was instituted against the detainee, and he signed a recognizance not to leave.

The Magaramkent District Court recognized conducting the search as lawful action.

On May 2, Zarema Balabekova, the wife of Khanmagomedov, reported that armed men drove away her husband to some unknown destination. On May 9, it becomes known, that Jafar Khanmagomedov is being kept in SIZO (pre-trial prison), and he is suspected of possessing an explosive device. Investigatory Division of the Derbent OVD also checks his involvement in organizing an illegal armed formation (IAF) or participation in it.

According to the Prosecutor's Office, on May 2, Jafar Khanmagomedov was brought to the police station by officers of Russian MIA's Division in the city of Derbent for committing an administrative violation, and during personal search, they found and confiscated items for manufacture of explosive device (a TNT block and an electric detonator). The investigation into his case under Part 1 of Article 222 of the Criminal Code of the Russian Federation continues.

The Prosecutor's Office emphasizes that checking of kidnapping of Ramazan Saidkhanov and Jafar Khanmagomedov was not carried out due to lack of grounds.

Kidnapping of Tagir Gudjaev and Rezvan Firzaliev in Derbent

The "Caucasian Knot" has reported that on May 16, in Derbent, unidentified armed men in masks beat and kidnapped two local residents Tagir Gudjaev, born in 1984, and Rezvan Firzaliev, born in 1985. This was reported by Ali Gajiev, a friend of the disappeared men, with reference to eyewitnesses.

"Checking of the report on kidnapping of Tagir Gudjaev revealed that on May 16, in Derbent, law enforcement agents detained Tagir Gudjaev. At personal search, a grenade F-1 with an igniting fuse and a large volume of "Hashish" drug were found and confiscated. Criminal case was instituted against the detainee under Articles "illegal possession and carrying of ammunition" and "illegal possession of drugs" of the Criminal Code of the Russian Federation. Supervising prosecutor recognized the decision to institute criminal case against Tagir Gudjaev as lawful," stated the message of the Dagestani Prosecutor's Office.

According to the report, "publication on the 'Caucasian Knot' website concerning the kidnapping of Rezvan Firzaliev was directed to the Derbent Prosecutor's Office for organization of inspection."

Till present, the position of Tagir Gudjaev or his representatives is unknown.

Kidnapping of Arsen and Rashid Ismailov in Makhachkala

The "Caucasian Knot" has reported that, according to the Dagestani regional organization "Pravozaschita" (Advocacy), on May 8, Rashid Ismailov was kidnapped by armed men in the yard of the house in Akushinsky Street in Makhachkala. According to Zhanna Ismailova, the mother of Rashid Ismailov, on May 8, Arsen, the Rashid's elder brother was kidnapped.

"The complaint, filed by Zhanna Ismailova, was received by the Dagestani Prosecutor's Office on May 11, and it was brought for checking to the Investigatory Department of the Kirov District and the Lenin District of Makhachkala of the Investigatory Committee of the Russian Federation (ICRF) in the republic. Following the results of the checking, in accordance with the decision of the investigator dated May 21, criminal case was instituted on the fact of kidnapping of R. A. Ismailov under Article "kidnapping". The Investigatory Division of the Leninsky District of Makhachkala continues checking of the fact of kidnapping, beating and subsequent release of Asrlan Ismailov (such a spelling of the name appears on the Prosecutor's Office website, note of the "Caucasian Knot"). The Republic's Prosecutor's Office took under control checking proceedings and investigation into the criminal cases on the facts of kidnapping of Ismailov brothers," the Prosecutor's Office statement reports.

Disappearance of Murtazaliev brothers in Makhachkala

The "Caucasian Knot" has reported that on March 7, Magomed and Abdulla Murtazaliev drove from the house by car and never returned. Parents of the brothers filed complaints to the Russian FSB in Dagestan, asking to reveal their whereabouts.

"On March 26, the Investigatory Department of the Soviet District of Makhachkala of the Investigatory Department of the ICRF in Dagestan received a complaint, filed by Abdullaeva, about the disappearance of her sons Magomed and Abdulla Murtazaliev. Checking was carried out on the Abdullaeva's complaint, and as a result, on April 5, criminal case was instituted on constituent elements of crime under Article "murder" of the Criminal Code of the Russian Federation. Till present, taken measures failed to reveal the whereabouts of Murtazaliev brothers. Investigation into the criminal case is under the control of the Republic's Prosecutor's Office," the Prosecutor's Office statement reports.

Disappearance of Timur Danilin, Makhachkala resident

The "Caucasian Knot" has reported that on March 25, Timur Danilin disappeared. Criminal case was instituted on the fact of his disappearance. According to relatives of Timur Danilin, he can be kept at the Police Division of the Novolak District.

"Investigatory Division received instructions to conduct investigatory work, aimed at revealing the whereabouts of T. Danilin. However, the search measures did not succeeded, and actions to reveal his whereabouts are underway. Investigation into the criminal case is under the control of the Republic's Prosecutor's Office," states the information, posted on the Prosecutor's office website.

On April 28, the press service of the Dagestani MIA reported that disappeared Timur Danilin was not detained by law enforcement agencies.

The Prosecutor's Office has emphasized that the information about involvement of law enforcement agents in kidnappings of people is of presumable nature only and is based on the fact that kidnappers are armed with weapons and wear camouflage and masks.

"Investigatory authorities take necessary measures to check every argument for involvement of law enforcement agents in commitment of crimes. However, in the course of pre-investigation checking and investigations into criminal cases of that category, no objective evidence of involvement of law enforcement agents in commitment of the indicated crimes has been received," the Prosecutor's Office statement reports.

Kidnapping of Alexander Misrikhanov in Makhachkala

The "Caucasian Knot" has reported that Alexander Misrikhanov was kidnapped, when on December 15, 2011, at 7:30 p.m., he left his office in Makhachkala. At that time, unidentified persons, presumably on a Lada Priora car of white colour without state registration number plates drove up to him, firing into air. They grabbed Alexander Misrikhanov, forced him into their car and drove away to some unknown destination.

"Alexander Misrikhanov was interrogated as a victim, and he testified that he did not know the kidnappers and the motive of his kidnapping. After the kidnapping, the kidnappers released him without any demands. He presents no claims against anyone in regard to his kidnapping, and he asks not to bother him anymore on that question," stated the Prosecutor's Office.

According to the Prosecutor's Office, the conducted investigatory actions and operational measures failed to reveal persons, who kidnapped Alexander Misrikhanov.
