Arbitration Court of Chechnya rejects tax inspectorate's claim to collect tax arrears from the "Union of NGOs"
The Tax Inspectorate cannot claim to recover the arrears from the "Union of Non-Governmental Organizations (NGOs)"; the decision was handed down today by the Arbitration Court of the Chechen Republic.
The "Caucasian Knot" has reported that the Inter-District Inspectorate of the Federal Tax Service of Russia No. 1 that operates in Chechnya demanded to collect from the "Union of NGOs" the arrears in the amount of 1,512,269 roubles, including, according to the Inspectorate, the tax, penalty and fine. According to the claimant, the arrears date back for Union since August 30, 2008.
The tax inspectorate asked the court to restore the time limitation statute, citing the force majeure - a virus onslaught on the computer network of the inspectorate. At today's session, tax inspectors have reiterated their claims presented in the lawsuit.
However today, Judge Alu Bachaev has ruled to refuse the tax inspectorate in restoring the limitation period, Taisa Isaeva, the head of the "Union of NGOs", told the "Caucasian Knot" correspondent.
She added that should the court had satisfied the claim of the tax inspectorate, her "Union" would have continued suing, said Taisa Isaeva.
A non-profit organization, as Ms Isaeva said, should not pay the income tax, as it is not implied in its Charter.
