At trial on attack on Nalchik, defendant Berov declared unlawful methods of inquiry
At the trial dealing with the attack on Nalchik on October 13, 2005, the prosecution announced the documents on refusals to institute criminal cases on defendants' complaints. The advocates and defendants complain that investigators use violence and threats in the course of inquiry.
The complaint of the defendant Aslan Berov says that he was beaten and forced to testify against his cellmates and received threats that his family would have troubles.
It follows from the documents announced by the state prosecutor that the service check had failed to establish facts of using violence and pressure against Berov.
"I'd like to note that in my case there was no detention, I myself appeared at Division 6," said Aslan Berov and explained that since the prosecutor's office and the investigating division gave no answer to his complaint, he appealed to the European Court of Human Rights (ECtHR).
After announcement of the refusal to initiate a criminal case on the complaint of the defendant Mukhamed Urusov on use of physical violence against him, his lawyer Lucia Shorova stated at that time she was not allowed to be present during the interrogation of her client.
"Urusov was brought to the UBOP (Department to Fight against Organized Crime) by his relatives on October 26; that is why, he's actually a voluntary surrender. At that moment he had no bodily injuries," said the advocate, adding that Urusov wanted to give explanations in her presence, but this was not allowed.
Statements were also announced about refusals to open criminal cases on complaints about policemen's misconduct lodged by defendants Boziev, Kuchmenov, Shavaev and others.
