Defence challenges court’s decision to arrest Magomedov
The investigators’ version in the case against Dagestani native Magomed Magomedov is unfounded, and some of the documents in the case have been falsified, advocates claim in their appeal. The defenders emphasized that even under torture, Magomed Magomedov had not given a confession.
The “Caucasian Knot” has reported that on January 27, a court arrested Magomed Magomedov. The native of Dagestan is suspected of illegally manufacturing and storing firearms. Public prosecutors claim that Magomed Magomedov is a relative of supporters of the “Islamic State” (IS), who are wanted and live in Syria. At trial, law enforcers did not provide any arguments in favour of the version about the Magomed Magomedov’s connections with a terrorist organization.
Magomed Magomedov claimed that after his detention, three law enforcers were torturing him using a stun gun and a mop.
The advocates of Magomed Magomedov have lodged an appeal against the court’s decision to arrest him.
“In the appeal, we pointed out the groundlessness of the investigators’ version and noted that the materials they obtained were got without the advocate, who was not allowed in the case. Even under torture, Magomed Magomedov did not give a confession,” explained advocate Mikhail Mushailov.
The defender has noted that a certificate from the FSB stating that “some of Magomed Magomedov’s relatives are wanted and involved in the IS*, and he himself maintains communication with them” became an indirect circumstance for choosing a pre-trial restriction measure against Magomed Magomedov.
As for the medical certificate, which allegedly did not show any injuries to the Magomed Magomedov’s body as a result of torture, the defenders suggest it has been fabricated.
The attention of the leader of Dagestan to the Magomed Magomedov’s complaint about torture by law enforcers in the Moscow Region could affect the investigation, analysts believe.
