North Ossetia court adjourns its decision with regard to lawyer Kodzaeva
Lenin district court of North Ossetia has adjourned its decision on whether or not to initiate a criminal case against lawyer Irina Kodzaeva accused by the General Prosecutor's Office investigator of violence, until October 15.
The "Causasian Knot" correspondent reports that Irina Kodzaeva is defended by two lawyers, Tsopboyev and Yakovlev, one of whom is based in Moscow.
The lawyers have filed a petition in court to the effect that the application of the prosecution to initiate criminal proceeding against lawyer Kodzaeva should not be granted.
They argue that the investigator's duties do not include decisions on "whether or not the lawyer should be allowed to attend" investigatory experiments. The most Viktor Pereverznev, the investigation officer, could afford was to phone the alert unit check point and call for an officer to monitor the procedure.
For reference: Viktor Pereverznev, the General Prosecution Office investigator, accuses lawyer Irina Kodzaeva under article 318, para. 1 of RF CC, use of violence against a public agent, claiming that I.Kodzayeva attacked him in the MIA building and beat him.
Meanwhile, Kodzaeva herself claims that, on the contrary, Victor Pereverznev, RF General Prosecutor's Office investigator, beat her and requests that the investigator should be brought to criminal responsibility for his actions.
