Court awards 30,000 roubles of compensation to resident of Chechnya for inspector's actions

On August 31, the judicial panel on civil cases of the Supreme Court of Chechnya upheld the decision of the Leninskiy District Court of Grozny of May 15, 2010, on awarding compensation to local resident Muslim Kulaev of the moral harm caused to him by actions of the inspector of the inter-district investigatory division (IDID) at the prosecutor's office of the Russian Federation for the Chechen Republic.

The Inter-Regional Committee Against Torture (IRCAT) reports that the compensation was awarded to Kulaev for the harm caused by the inspector Tapaev's refusal to provide materials of the check for acquaintance.

According to human rights activists, the judges agreed with the reasons of the lawyers of the IRCAT, who proved the lawfulness of the decision passed by district court on May 15, 2010. In the near future, a petition will be lodged to the prosecutor's office of the Chechen Republic with a request to file a regress suit directly against inspector Tapaev.

Earlier, the IRCAT had initiated a public investigation under the application of citizen Gelaeva on the fact of application of torture by employees of the Itum-Kalin ROVD (District Interior Division) of the Chechen Republic to her brother Muslim Kulaev.

In the context of this investigation, lawyers of the IRCAT sent an application to the head of the Grozny IDID about the crime - causing bodily injuries to Kulaev.

However, inspector Tapaev passed a ruling, on the basis of the materials of the check, to refuse to open a criminal case, in spite of the fact that the materials of the case contain an expert's conclusion confirming illegal actions of law enforcers.

Lawyers of the IRCAT lodged a petition asking to get acquainted with and copy the materials of the check, which was rejected.

Later, the refusal to give out the materials of the case was appealed against at the Grozny Court, which found the inspector's ruling to be illegal and obliged him to eliminate the violations.
