Krasnenkov is going to appeal to the Supreme Court concerning dismissal of his claim against “Memorial” Human Rights Center

Andrey Krasnenkov, attorney of Head of Chechnya Ramzan Kabyrov, is going to appeal the Supreme Court of the Russian Federation concerning the verdict of the panel of judges of Moscow city court who on November, 14, dismissed his appeal against the judgment of Tverskoy district court on his anti-defamation lawsuit against “Memorial” Human Rights Center.

In 2010 Krasnenkov submitted a civil action against “Memorial” Human Rights Center. The reason was an article “Ramzan Kadyrov’s attorney misleads the journalists” posted on “Memorial’s” web-site on September, 30. In the claimant’s opinion, the article contained “slanderous fabrications”. The proceedings were held up on February, 14, 2011, upon Krasnenkov’s request. On July, 4, 2012, Tverskoy district court of Moscow dismissed the claim.

Krasnenkov’s appeal against the judgment of Tverskoy district court dismissing his anti-defamation lawsuit with a request of recovery of 500 thousand rubles from “Memorial” as compensation of moral damage was considered in Moscow city court on November, 14.

Sergey Davidis, representative of “Memorial” Human Rights Center”, set forth his objections against the claim before the court flatly disagreeing with Krasnenkov’s arguments.

However, the claimant himself entered a motion to attach a linguistic expert’s report done in an expert center to the materials of the case. The court attached the document in spite of objections from Davidis whom Krasnonkov had not familiarized with it before but just passed it over to him during trial.

In spite of further evidence on the case produced during trail the panel of judges for civil cases of Moscow city court dismissed the plaintiff’s claim.  

Krasnenkov entered a motion of reversal of the judgment of Tverskoy court as illegitimate and referring it for a new consideration because in his opinion, representatives of “Memorial” produced a past due warrant of representation of the defendant in court.

“One can estimate the actions of judge Fedosova of Tverskoy court of Moscow as a crime because improper defendants from “Memorial” participated in the trial, they even had a past due warrant. It is very easy to verify. I received this information a week later. I am beginning to prepare for trial in the Supreme Court”, Andrey Krasnenkov declared.

The verdicts of Tverskoy and Moscow city court will receive a standing judgment in the Supreme Court, either, representative of “Memorial” Sergey Davidis, in his turn, told the “Caucasian Knot” correspondent.
