An eighty-year-old disabled man in Ingushetia strives for resettlement from decrepit dwelling
An eighty-year-old resident of Ingushetia Isa Esmurziev, first category disabled person, states that the authorities refuse to provide him with dwelling ignoring the decision of the court.
Isa Esmurziev told the “Caucasian Knot” correspondent that he lived in Nasyr-Kort municipal district with his family consisting of 13 persons in severe material conditions. Since 2003 his family has been on the dwelling waiting list according to the program of resettlement from decrepit dwellings.
On February, 2010, Magas district court passed a judgment obliging the Administration of Nasyr-Kort municipal district to provide Esmurziev with dwellings within the framework of federal target program “Dwelling. 2002 – 2010”. However, according to Esmurziev, the judgment has not been executed for already three years.
According to lawyer of the Administration of the town of Nazran Adam Sapraliev, “the point is that Esmurziev has a private house but private houses were not included into the program, only blocks of flats, i.e. the judgment was incorrect”.
According to Ruslan Mutsolgov, lawyer of human rights center “MASHR”, actions of any official aimed at resistance to execution of a judgment fall under jurisdiction of criminal legislation and are qualified as “malicious deviation from execution of a judgment”.
