Court in Dagestan rejects lawyer's complaint about CEC inaction

Today, the Supreme Court of Dagestan has rejected the motion lodged by the lawyer Rasul Kadiev, who demanded to recognize as illegal the inaction of the Central Election Commission (CEC) of Dagestan, which failed to announce the start of the election campaign.

Let us remind you that Rasul Kadiev turned to the Supreme Court on June 27 and challenged the inaction of the CEC and demanded to nullify the resolution about appointment of an extraordinary session of the parliament dedicated to election of the head of the republic. According to the lawyer, the election campaign and the election should be announced by the CEC, not by the parliament.

In his turn, Kismatulla Alimagomedov, who represented the interests of the CEC at the Supreme Court, said that the law does not specify exactly which convocation of deputies has the right to elect the head of the republic.

The court also listened to Omar Gasanov, the trustee of the acting president of Dagestan who treated Kadiev's claims as illegal and groundless. "Since the principles and the concrete form of electing the head of Dagestan had been established by the Constitution well before the assumed election campaign, the reasons for appointing the election by universal suffrage and secret ballot have disappeared," said Gasanov.
