ECtHR finds Russia guilty of violating Tazievs' rights in Ingushetia
The European Court of Human Rights (ECtHR) has ruled on the case "Tazieva et al versus Russia", finding a violation of an Article of the European Convention on Human Rights (ECHR) and awarded a compensation of moral damage to the victims of five thousand euros.
The ruling was passed on July 18 on the lawsuit, filed by close relatives of Ali Taziev (also known as Magas), one of the leaders of the armed underground.
The incident, after which Tazievs filed the complaint, occurred on December 27, 2005. On that day, armed men in black masks and military uniform used an ATC (armoured troop carrier) to break down the gate of the Taziev family household and drove into the yard. They ordered the family to leave the house, roped one of them and threatened with firearms. They spent several hours in the household. After they left, the family saw that the furniture, carpets and crockery were broken and damaged, and documents and valuables were stolen. The criminal investigation into the theft and illegal search was ineffective, says the complaint communicated by the ECtHR on September 27, 2011.
The ECtHR found a violation of Articles 8 of the ECHR in regard to the right to respect one's private and family life.
The Tazievs also stated harassment by power agents and a deliberate exploding their household on March 3, 2011. This military action was a result of the family's repeated appeal to the ECtHR. The communication on this complaint is pending, said the lawyer Karina Moskalenko.
