Court considering attack on Nalchik dismisses defence's motion to resume investigation
At the Supreme Court (SC) of Kabardino-Balkaria, in the course of the oral arguments of the parties in the case of the attack on Nalchik, the defence has filed a motion to resume the investigation. The SC rejected the motions, the "Caucasian Knot" correspondent reports.
On October 13, 2005, as a result of attack on the capital of Kabardino-Balkaria, 35 law enforcers and military personnel, 15 civilians, and 95 attackers were killed. The trial in the case on the attack was started in 2009. The prisoners' dock contains 57 defendants. Most of them plead not guilty.
On August 19, the oral arguments of the parties began at the Supreme Court of Kabardino-Balkaria.
Prior to the beginning of the oral arguments of the parties, advocate Oleg Kelemetov filed a motion to resume the judicial investigation and to forcibly bring to the courtroom Khachim Shogenov, the former Minister of Internal Affairs (MIA), for testifying as a witness.
Prosecutors opposed the motions filed.
"In accordance with the Article 294 of the Code of Criminal Procedure, the judicial investigation can be resumed if new circumstances arise. Such circumstances have not arisen," emphasized Olga Chibineva, the public prosecutor. She has stated that "the guilt of the defendants in commitment of the crimes is proved."
The Court has found both the motions filed by the advocate unfounded and dismissed them.
