At trial in case of attack on Nalchik, defence asks to sentence defendants to terms already spent by them in SIZO

In the course of the court session held on the case of the attack on Nalchik, advocates of the defendants in the episode "Landysh" (Lily-of-the-valley), asked the court to sentence their clients to terms of imprisonment already spent by them in custody in SIZO (pre-trial prison).

The court started the debates in trial on August 19, 2013. Prosecutors ask to sentence the defendants to various terms of imprisonment, including seven defendants to life imprisonment.

At the court session held on September 23, the court began to listen to advocates in the episode "Landysh". According to the prosecutors' version, person, who on the eve of October 13, 2005, gathered in the village of Landysh at the summer cottage belonging to parents of defendant Azret Shavaev, prepared an attack on Department or Combating Organized Crime Activities (known as UBOP) of the Ministry of Internal Affairs (MIA) of Kabardino-Balkaria. The attack failed to take place, since a neighbour of the summer cottage noticed the group and reported on it to the police.

The episode involves defendants Zalim Ulimbashev, Zaur Erzhibov, Ruslan Khanov, Zaur Tokhov, and Azret Shavaev. The prosecutors believe that the defendants' guilt in the episode has been proved.

Advocate Yuri Getokov, who represents the interest of Zaur Erzhibov, believes that the charges against his client are not proved. Yuri Getokov asked the court to consider at sentencing that Zaur Erzhibov voluntarily surrendered, had no earlier criminal records, and had been characterized positively.

Advocate Kazbek Dateev, who represents the interests of Ruslan Khanov, has stated that his client admits his guilt only under Article 222 of the Criminal Code of the Russian Federation illegal possession, storage and transfer of weapons. The prosecutors have charged all defendants under Article 210 of the Criminal Code of the Russian Federation participation in a criminal grouping, which is a particularly serious crime, Kazbek Dateev has noted. According to the advocate's version, it was done to ensure "no need to prove the defendants' guilt in other crimes."

The advocate has asked to pronounce sentence to Ruslan Khanov with taking into account the term that had been already served by the defendant.

Advocate Marat Ozrokov, who represents the interest of Zaur Tokhov, has stressed that his client did not take any weapons in his hands and that he fled the summer cottage with Ruslan Khanov and others. Marat Ozrokov has urged the court to objectively assess all the circumstances and to pronounce sentence to Zaur Tokhov with taking into account the term that had been already served by the defendant.
