Azerbaijan: case of Yadigyar Sadygov, "Musavat" activist, sent to court
Azerbaijan has completed the preliminary investigation in relation to Yadigyar Sadygov, an adviser to the chairman of the "Musavat" Party; the case has been sent to the court, said the lawyer Khalid Bagirov.
The "Caucasian Knot" has reported that Yadigyar Sadygov was detained on June 27 as a suspect on the basis of a complaint lodged by Rashid Karimov, a resident of Lenkoran and a veteran of the Karabakh War, who claimed that Sadygov and his two friends insulted and then beat him for no reason.
Sadygov's arrest expired on October 22; and his further detention is illegal, said Khalid Bagirov, the activist's advocate. The lawyer filed a complaint with the Sabunchu District Court of Baku.
Investigating authorities believe that from the moment of arrival of the case to the court, the defendant may be detained without a court order, as the period of the pre-trial proceedings is over.
However, according to Bagirov, the European Court of Human Rights (ECtHR) has precedents, under which a suspect in a crime cannot be detained without a court order.
Human rights organizations, the Human Rights Club, the Institute for Peace and Democracy and the International Society of Legal Studies treat Sadygov as a political prisoner. They believe that the activist is persecuted for his oppositional activities.
