HRC "Memorial": decisions of ECtHR on case "Djabrailov et al versus Russia" and similar ones prove the guilt of Russian authorities of committing war crimes
The decisions of the ECtHR on the case "Djabrailov at al versus Russia" and on other similar cases dealing with the kidnappings committed in Chechnya from 1999 to 2006, indicate the guilt of Russian authorities of committing war crimes and crimes against humanity, said Oleg Orlov, a member of the board of the Human Rights Centre (HRC) "Memorial". In the above Djabrailov's case the ECtHR found violations of four articles of the European Convention on Human Rights (ECHR) in respect of residents of Chechnya, Tatiana Chernikova, a lawyer of the HRC, has emphasized.
"These 13 persons were kidnapped in different districts of Chechnya in 2000-2004. They were all detained by Russian soldiers; all were found missing; therefore, their right to life was violated; the crimes against citizens' freedom were not investigated, and their personal immunity was broken," Tatiana Chernikova, the manager of the programme "Human rights Defence through International Mechanisms" of the HRC "Memorial", has commented on the decisions of the ECtHR to the "Caucasian Knot" correspondent.
"The conclusion that can be drawn from this scope of cases looks as follows: certain offenses of power agents, about which residents of Northern Caucasus had complained, make a part of the state system of illegal violence, which includes kidnappings, torture, illegal prisons and extrajudicial executions. Thus system could not work without clear support of the very top of the Russia's vertical of power," said Orlov.
