Sochi Court dismisses NGO's demand to recover Akhshtyr Quarry

The Adler District Court has dismissed the claim lodged by the public movement "Law and Order" against the Open Joint-Stock Company (OJSC) "RZhD" (Russian Railways). In their claim, the public activists demanded to return the natural Akhshtyr Quarry to its original position, the "Caucasian Knot" correspondent reports.

The "Caucasian Knot" has reported that in March 2014, the public civil movement "Law and Order" lodged to the Adler District Court of Sochi a claim against the OJSC "RZhD" and a number of public institutions requesting to oblige them to take out construction "Olympic" waste from the Akhshtyr Quarry and stop any works there.

According to the plaintiff, the works in the Akhshtyr Quarry were held without the necessary documentation and also inflicted damage to Sochi environment.

At the court hearing held on September 4, a representative of the OJSC "RZhD" claimed that the company objected to the satisfaction of the claim.

Meanwhile, the "RZhD" representative has acknowledged that the company's operations in the Akhshtyr Quarry were not subjected to the state ecological expertise. "We were failing in meeting the deadlines. We had to fulfil the task of the government. However, we have paid to the budget about 2 million roubles of fines for violations, and therefore we believe that we should not be brought to responsibility twice," state the representative of the OJSC "RZhD", a defendant, during the debates.

The Court has pronounced the decision to dismiss the claim.

Roman Shikarev, a member of the NGO "Law and Order", has told the "Caucasian Knot" correspondent that the public activists are going to appeal against the Court's decision.
