Keeping Khaiser Dzhemilev in Krasnodar SIZO violates his rights, says the defence

As stated by Nikolai Polozov, the advocate of Khaiser Dzhemilev, the detention of his client, who is a Ukrainian citizen and a son of Mustafa Dzhemilev, the leader of Crimean Tatars, in the SIZO (pre-trial prison) of Krasnodar, and the consideration of his case by Russian investigative and judicial authorities violate the legal norms of the Russian Federation and the European Convention.

The "Caucasian Knot" has reported that Khaiser Dzhemilev is accused of killing the 44-year-old Fevzi Edemov, who worked in his household, committed on May 27, 2013.

According to the advocate, in July 2014 the European Court of Human Rights (ECtHR) obliged Russia to release Dzhemilev-junior from custody. However, the Russia's Supreme Court ignored the ECtHR's decision and sent the case for consideration to the Krasnodar Territorial Court.

According to the advocate, now all legal leverages have been exhausted; and the issue of releasing or convoying Khaiser Dzhemilev to Ukraine, whose citizen he is, can only be decided by "the political will of Russian authorities."

According to Polozov, initially, the Prosecutor's Office of the Crimea opened a criminal case under the article of "premeditated murder"; then, the case was re-qualified into "premeditated murder with aggravating circumstances". Khaiser Dzhemilev is in custody since May 2013.

According to Polozov, Dzhemilev "accidentally made a shot from the window of his house and got into Edemov's head, because his did not know that the rifle was taken off the safety lock." The advocate insists that it was a reckless homicide (involuntary manslaughter).
