A court in Kabardino-Balkaria refused to consider a torture case of Kudayev, a Guantanamo prisoner

It became known to a correspondent of the "Caucasian Knot" that the Nalchik City Court refused to satisfy a complaint of Rasul Kudayev, who was arrested on accusation of participation in the events of October 13, 2005, a citizen of the settlement of Khasanya and a former prisoner of the American prison in Guantanamo, on refusal of the investigator of the prosecutor's office of Kabardino-Balkaria to initiate a criminal case on the facts of being tortured. The declaration part of the court decision runs that the Kudayev's application was considered by an investigator of the prosecutor's office, and a "justified decision" was made.

Recall that Rasul Kudayev was detained on October 23 on suspicion in organizing an attack on the Road-Patrol Service (RPS) in the settlement of Khasanya. Evidences of earlier detained attack participants were the reason for the arrest.

However, Rasul Kudayev does not admit his guilt. His relatives also state that on the day of the attack he was at home. Rasul Kudayev could not take part in the attack for his health condition. According to his mother, Rasul Kudayev was so heavily beaten after detainment that they had to send for the ambulance. The mother could take a certificate from the ambulance that the doctors were called in to help the detainee Rasul Kudayev and about his condition as of the moment of call in. However, the court found no grounds to downturn the investigator's conclusion.

Rustam Eldzherukaev, Rasul Kudayev's lawyer, told that the ruling of the Nalchik City Court will be appealed against at the Supreme Court of Kabardino-Balkaria.
