Trial of human rights activist Boliev in Dagestan will continue on Monday

In Khasavyurt (Dagestan), the court process on human rights activist Osman Boliev, head of the Dagestan regional public organization "Romashka," accused of storage, acquisition and bearing of firearms, will continue on Monday, April 24. The start of the sitting is appointed on 2 p.m. at the Khasavyurt City Court. Ruslan Boliev, defendant's brother told this to the correspondent of the "Caucasian Knot."

According to R. Boliev, yesterday, on April 21, the court session did not take place because the documents requested by the court under the defence petition did not arrive in tome from the City Interior Headquarters of Khasavyurt. Salimat Kadyrova, Osman Boliev's advocate, told the correspondent of the "Caucasian Knot" that the defence petitioned on examining at the court of the accounting logbook of crimes for December last year, and of the registration logbook of the crimes and offenders of the Khasavyurt GOVD, in order "to check the presence or absence in it of an entry about detection of the crime indices in the actions of an unidentified person who allegedly sold a grenade to Boliev, since in relation to this person the investigation body isolated the material into a separate proceedings, but we doubt that this criminal case was ever initiated." In her words, the state prosecutor was "furiously objecting" to satisfaction of the latter petition, and offered to limit themselves with the registration book of criminal cases of the prosecutor's office, sanctioned for opening by the prosecutor.

"Additionally, we petitioned on examining the logbook on deployment of forces and means of the GOVD in order to clarify who started the duties of the operations on duty, and who was replacing Umarov, inspector for the work with detainees brought to the station, on November 16, 2005, and to summon them to the court for giving evidences," Salimat Kadyrova said.

We remind you that on February 13, Osman Boliev was released from custody under petition of the defence and then underwent a course of treatment at the Khasavyurt city hospital.

Boliev was detained on November 15, 2005, by GIBDD members under the pretext of checking the information about his car, which looked, in the words of road police inspectors, like the one registered as hijacked. However, on the way to the Khasavyurt militia station, Boliev's car was stopped by the fighters of the Mobile Unit of the MIA RF for operative and search activities. The GIBDD workers handed Boliev over to the fighters of the Mobile Unit and left. The latter, in their turn, put O. Boliev into their car, put a bag over his head, handcuffed and brought to the interior department of Khasavyurt. According to the human rights activist, in militia he was tortured for several hours, then searched, and they "detected" on him a disassembled grenade.

Initially, they also tried to accuse Boliev of taking part in an illegal armed formation. Already on the following day after detainment, on November 16, 2005, the RIA "Dagestan" reported with a reference to the press service of the MIA of Dagestan, that O. Boliev, an active member of illegal armed formations, was detained in Khasavyurt, who, under the data of law enforcement bodies, was a member of the grouping of Arslanbek Abdulsheikhov, killed in Moscow in the "Nord-Ost" Theatre in 2003. The report also stated, that special forces possessed data on the detainee's participation in armed actions against federal forces in the territory of the Chechen Republic and that on the "militant" at detainment "an RGD-5 grenade with detonator was found and confiscated."

"The search was made not at Boliev's detention place, but only in the GOVD building. If we follow a common sense logic, Boliev, when following the GIBDD car, could quite easily get read of the grenade parts, but he didn't do it," the "Public Verdict" Foundation stated. "The documents presented to the prosecutor's office for initiating a criminal case missed the grenade description, evidences of the witnesses who were present at the search (the inquiry materials were presented only several days later), and the materials on administrative detainment." It is interesting that the Boilev's case investigator sent the RGD-5 grenade to examination, while the expert presented his conclusion on an RGN grenade ("Afghan" type). Lawyer Salimat Kadyrova supposed, in her talk to the correspondent of the "Caucasian Knot" that the grenade was replaced since the first one had already been "highlighted" somewhere.

In the opinion of a number of experts, the main reason of Boliev's detainment and accusation was his professional activities. The "Romashka" public organization, headed by Boliev, was initiator of resonant court proceedings on the case of kidnapping in Dagestan on October 19, 2004, of local citizen Yaraly Israilov by the employees of the Khasavyurt GOVD. Boliev, together with Karina Moskalenko, Commissioner of the International Commission of Lawyers and Head of the Centre to Promote International Defence, compiled and sent an application on this case to the European Court for Human Rights. Besides, Boliev made public the fact of murder of a 6-year girl Summaya Abdurashitova by the members of law enforcement bodies of Dagestan during a special detainment operation of suspected criminals. She was killed right in her bed on March 14, 2005, in the village of Solnechnoe of the Khasavyurt District from a frag of a large-calibre shell. A complaint on this case was also lodged to the European Court.

The Human Rights Centre "Memorial" declared on March 16 that the "criminal prosecution in Dagestan of Osman Boliev has clearly expressed political motives."
