Court refuses to remove Dagestani resident from police preventive registration

A resident of Dagestan did not succeed in seeking in court a removal from the police preventive registration list under the category of “extremist”. The court based its decision on the police’s assertion that no such police preventive registration lists were run.

In March 2017, the Dagestani Minister of Internal Affairs announced the destruction of orders for police preventive registration lists under the category of “extremist”, but human rights defenders announced the preservation of the practice of the police preventive registration for believers. The law enforcement bodies continue to compile their secret lists of alleged religious extremists, advocate Shamil Magomedov notes.

A court in Dagestan refused to deregister local resident Ramis Abubakarov as an extremist. The court’s decision was made on the basis of the response from the police about the absence of such police preventive registration lists. At the same time, the court pointed out that the police registration of the resident of Dagestan does not violate his rights and freedoms, the “Kavkaz.Realii”* reports.

Ramis Abubakarov learned about being put on the police preventive registration list when he tried to get permission to carry pneumatic weapons. The preventive registration case states that Ramis Abubakarov assists “in provision for personnel of a tactical group” participating in the special military operation in Ukraine.

The “Caucasian Knot” has reported that in December 2022, the Supreme Court (SC) of Dagestan returned the case of teacher Khussein Khamzatov to the court in Makhachkala after the consideration of a complaint against the decision to recognize as illegal the police preventive registration of Khussein Khamzatov under the category of “extremist”. Earlier, the court obliged the Ministry of Internal Affairs (MIA) of Dagestan to remove Khussein Khamzatov from the police preventive registration lists, recognizing the law enforcers’ actions as illegal. The Dagestani MIA challenged the court’s decision.

On May 23, 2022, a court in Makhachkala dismissed a lawsuit filed by Ramazan Nazhduev against the MIA on the issue of the police preventive registration. The court’s decision was justified by the fact that Ramazan Nazhduev did not provide enough data to prove that he was put on the police preventive registration lists. The authorities of Dagestan want to keep the police preventive registration, but they do not have the right to apply it officially in the absence of any relevant law, lawyer Marina Agaltsova emphasizes.
