SC of Kabardino-Balkaria rejects the challenge of prosecutor in Nalchik attack case

Today, at the session of the Supreme Court (SC) of Kabardino-Balkaria on the criminal case on the events on October 13, 2005, the court has rejected the defendants' petition challenging Olga Chibinyova, head of the prosecution group, and a number of other public prosecutors. The court has extended the custody of all 58 defendants by three months more.

While refusing to satisfy petitions to challenge Olga Chibinyova, the court has referred to the fact that "the prosecutors have the role of criminal prosecution on behalf of the state", which they realize in the course of the litigation. They have no other functions but to support the accusation or refuse from it.

In the opinion of the court, "everything, to what the defendants have referred, has no remedial value, including entrance of any references into the case files."

However, the court has satisfied the petition to challenge public prosecutor Bagov, since one of the witnesses is his cousin.

The court has also satisfied the petition of defendant Kaziev challenging advocate Rasul Eldzherukaev, and appointed Zekoreev, already participating in the case, as his advocate.
