In Dagestan, lawyer Sapiyat Magomedova files complaint about inaction of investigatory bodies

On June 18, lawyer Sapiyat Magomedova filed a complaint to court about inaction of representatives of the investigatory agencies, who were engaged in the investigation into two cases, in which she had been a figurant. According to the lawyer, both cases are closed; however, her personal items, confiscated as material evidence, in particular, her mobile phone, were not returned, and the investigator fails to inform the Information Centre of the Ministry of Internal Affairs (MIA) about closing the criminal case against her.

The "Caucasian Knot" has reported that the incident, which formed the basis of at once two criminal cases, occurred on June 17, 2010. Investigator of the Khasavyurt GOVD (City Interior Division) did not allow the lawyer Magomedova to meet her client, and a dispute ensued, during which the lawyer Magomedova was beaten. However, the police officers from the GOVD stated that Sapiyat Magomedova herself attacked them, and accused her of insulting them. On March 12, it became known that both cases, which were at the Prosecutor's Office of the city of Khasavyurt, were closed.

According to the lawyer, in the resolution to close the criminal case, the investigator failed to solve the issue of material evidence, including return of the mobile phone, belonging to her.

Sapiyat Magomedova has noted that in the course of clarifying the circumstances related to the situation on the return of her mobile phone, it became clear that the investigator Rustam Baulov failed to send to the Information Centre of the MIA of the Republic of Dagestan the information on closing the criminal cases, in which the lawyer was a figurant.

"At my request, the Information Centre informed me that the information on progress of criminal cases, instituted against me, has not yet been presented. This means that the MIA has no information on the fact that the case against me was closed yet on December 28, 2011. This means that, formally, I have been yet a suspect in one case and under a recognizance not to leave, and I have been a victim in the other case," the lawyer said.

"I have sent a written complaint, addressed to A.Yu. Savrulin, Chief of the Investigatory Department of the Investigatory Committee of the Russian Federation (ICRF) in the Republic of Dagestan about the above circumstances, asking to eliminate the violations. However, the Investigatory Department of the ICRF in the Republic of Dagestan has ignored my complaint; till present, I received no response to the above complaint, although a month had passed since the submission of the complaint, my mobile phone was not returned to me, the information to the Information Centre of the MIA in the Republic of Dagestan on closing of the criminal case was not presented, and, therefore, my constitutional rights and freedoms were violated," states the text of the complaint, filed by Sapiyat Magomedova to the Soviet Court.

In this regard, Sapiyat Magomedova asks the Court to recognize action (or inaction) of the investigator Rustam Baulov and Alexei Savrulin, Chief of the Investigatory Department of the ICRF in the Republic of Dagestan as unlawful and oblige them to eliminate the violations committed with regard to her.
