Relatives of convicted Dagestani resident claim that FSIN violates his rights

Relatives of Ziyautdin Shapiev, the residents of Dagestan, who was sentenced to 15 years of imprisonment in a high security colony for aiding members of illegal armed formations (IAFs), claim violation of his rights. He serves his sentence in the Tomsk Region.

The "Caucasian Knot" correspondent was told by staff members of the organization "Pravozaschita" (Advocacy), they received an appeal of Zaza Yusupova, a resident of the village of Tukhchar of the Novolakskoe Region.

She has reported that her son Ziyautdin Shapiev is being kept without explanations at the medical penitentiary institution (MPI) No. 1 of the Department of the Russian Federal Penitentiary Service (known as FSIN) in the Tomsk Region, although he was to serve his sentence in the town of Ashino.

According to Zaza Yusupova, personnel of the penitentiary institution violate her son's rights. "They inform him of remitted money too late; they do not allow him calling from a payphone and do not hand over folk medicines to him," she said.

"Initially, Ziyautdin was kept at the MPI, since he earlier suffered from tuberculosis in the open form, from which he fully recovered, having undergone the full course of therapy," Zaza Yusupova stated.

According to her, the required examination and lung fluoroscopy have confirmed that Ziyautdin Shapiev does not suffer from tuberculosis. "Despite that fact, they continue to keep him at the MPI-1", the woman has noted. She supposed that was the way to put pressure on her son.

The woman herself did not appeal to law enforcement and supervisory bodies, referring to her poor knowledge of Russian language. Meanwhile, the "Caucasian Knot" correspondent was not explained by official why Ziyautdin Shapiev is kept namely at the medical penitentiary institution. However, the official have added that the MPI No. 1 is really intended for the maintenance and medical treatment of prisoners, suffering from active form of tuberculosis.

According to the source, the very medical penitentiary institution of the FSIN did not received complaints about living conditions of prisoners. "We have all the conditions for medical treatment and keeping of prisoners, who can also attend evening school and go in for sports by their wishes. The MPI also has prayer rooms for Christians and Muslims."

Lawyer Djamal Aliev has told the correspondent that to transfer a convict to a medical penitentiary institution, there should be the decision to the Chief of Territorial Administration of the Russian FSIN at the place of sentence service and mandatory written consent of a patient or his legal representatives to the proposed examination and medical treatment. No such documents were presented to the relatives of the convict.

"As far as parcels are concerned, the procedure is governed by the internal regulations of penitentiary institutions. Convict can receive only those things and objects, food products that are not included in the special list," Djamal Aliev has explained.
