Case against persons who surrendered under guarantees of adaptation commission returned to prosecutor's office in Dagestan

At the trial against seven residents of Dagestan, who passed the adaptation commission of militants, the Supreme Court of Dagestan returned the case to the prosecutor's office at the request of lawyers in connection with the fact that the defendants did not receive copies of the indictment.

During the preliminary court hearing, the defendants Fakhrudin Takhmezov, Temirlan Amirov, Arsen Isaev, and Nariman Mirzamagomedov stated that they had not been given copies of the indictment in the case, although they had signed a receipt of their delivery. The defendants stated that two hours prior to the preliminary court hearing, several sheets of paper with the wording of the charges were brought to them; however, the very indictment was not given to them.

Other three accused Zaur Makhmudov, Zamir Agashirinov and Telman Gadjimustafaev stated that investigator asked them to sign the receipt of a copy of the indictment and promised to bring it later; however, they refused to sign the receipt of delivery.

According to Rasul Kadiev, one of the lawyers, the defendants have examined only 30 volumes of the criminal case, and from where other four volumes appeared and what they contain are still unknown.

The judge granted the request of the lawyers and pronounced the decided to return the criminal case to the Prosecutor of the Republic of Dagestan. The pre-trial restriction measure to the defendants was left unchanged keeping in custody.
