A resident of Dagestan demands investigation of rape of his underage daughter

Resident of the settlement of Karabudakhkent, Dagestan, Magomednabi Nazhmutdinov complains of investigators who refused to initiate a criminal case against persons who according to him committed coercive sexual actions to his underage daughter. Representatives of investigative bodies informed that after refusal of starting criminal proceedings inquiry upon Nazhmutdinov's statement was recommenced upon discovery of new facts.

According to Magomednabi Nazhmutdinov, in October, 2010, a resident of Karabudakhkent persuaded his underage daughter to sexual affair by fraud.

"Later he told his friend about it. His friend by blackmail forced my daughter to start a sexual affair with him, too. Then this man also told his friends about his "heroic deed". They started blackmailing my daughter. During two years different persons blackmailed the girl and persuaded her to sexual affair. According to her, there were 11 of them", Nazhmutdinov told the "Caucasian Knot" correspondent.

According to the man, on June, 25, this year, his daughter unable to stand this blackmail told him everything. "After telling me she took several boxes of "adelphane" soporific. She was hardly brought round. On the same day I submitted a statement to the police", Nazhmutdinov said.

He also says that after he submitted the statement some of the suspects started threatening him and his daughter.

"They beat me up. Passers-by saw it but no one interfered. I summited a statement on this incident, too, but there were no eyewitnesses. The criminal case initiated was later dismissed", Nazhmutdinov said.

He added that the suspects' relatives today threatened him, tomorrow offered money trying to make him withdraw his statement.

Nazhmutdinov also pointed out that some suspects' relatives worked in law enforcement bodies.

According to him, after that his daughter was interrogated in inter-district Investigative Department of Kaspiysk without the presence of her legal representatives. "Their investigative actions were limited to that. First they did not inspect the scenes of the incident, carried out no forensic examination, did not interrogate possible witnesses. During this period some of the defendants not only left the republic but one of them went abroad. A video record of rape also disappeared. They were concealing all traces of a crime while the investigative bodies were thinking whether to start criminal proceedings or not", the man said.

On September, 5, Nazhmutdinov received a copy of a resolution of refusal to initiate a criminal case dated August, 12, from Kaspiysk inter-district Investigative Department.

The resolution runs that the claimant's daughter was interrogated and forensic medical examination was carried out. According to the results of the expertise, no signs of coercive sexual actions were found on the girl's body.

Based on the fact that the sufferer's statements were not proven Kaspiysk inter-district Investigative Department dismissed the criminal case, the document runs.

Nazhmutdinov pointed out that earlier he also got a refusal of starting criminal proceedings.

"I first got a refusal on July, 26. My attorney appealed against this resolution. They started reviewing the statement but again brought a similar resolution of refusal. We appealed against it again. I sent a complaint not only to investigative departments but also to the Administration of the President and Prime Minister of the Russian Federation, Prosecutor General of the Russian Federation, Director of Federal Security Service of the Russian Federation, Children's Ombudsman with the President of the Russian Federation and other bodies", the man says.

Nazhmutdinov also appealed the organization "Mothers of Dagestan for Human Rights" for help.

Chairperson of the organization Svetlana Isaeva told the "Caucasian Knot" correspondent that she also submitted a number of statements to both different bodies of authority and human rights organizations.

"The resolution of refusal to initiate a criminal case runs that one expertise is not yet accomplished. Besides, according to the Criminal Code of the Russian Federation, the absence of traces of coercive sexual actions on the victim's body does not mean that such actions never took place. It should be also added that the investigators interrogated only six suspects while, according to the girl, there were eleven", Isaeva said.

Press Service of Investigative Committee of Dagestan declared that inquiry on Nazhmutdinov's statement of coercive sexual actions to his daughter was recommenced.

The persons Nazhmutdinov accuses of rape of his daughter or their representatives are yet inaccessible for comment.
