Azerbaijani ex-Minister of Public Health files complaint to CoE about Azerbaijan's failure to fulfil ECtHR's decision

Ali Insanov, ex-Minister of Public Health, who is serving a prison sentence in Azerbaijan, has filed a complaint to the Committee of Ministers of the Council of Europe (CoE) about the failure of the Government of Azerbaijan to fulfil the judgment pronounced with regard to him the European Court of Human Rights (ECtHR). This was reported by Togrul Babaev, an advocate of Ali Insanov.

The "Caucasian Knot" has reported that on March 14, the European Court of Human Rights (ECtHR) found that the rights of Ali Insanov, ex-Minister of Health, who is serving a prison sentence on charges of economic crimes, were violated. The ECtHR obliged Azerbaijan to pay Ali Insanov the compensation in the amount of 10,000 euros.

The advocate of Ali Insanov has explained that since the Government of Azerbaijan did not file an appeal to the Grand Chamber of the ECtHR within three months, the verdict of the Strasbourg Court came into force on June 14.

"In accordance with the legislative procedures, the Supreme Court (SC) of Azerbaijan was to bring the issue to the Plenum of the SC, and it was to make a decision to cancel the decisions of the Azerbaijani courts in the case against Ali Insanov and to release him from prison," Togrul Babaev told the "Caucasian Knot" correspondent.

However, within the two months following the notification of the Supreme Court about the ECtHR's decision, the case against Ali Insanov was not brought to the Plenum of the SC.

Let us remind you that in October 2005, Ali Insanov was arrested on charges of participating in a conspiracy to overthrow the power in Azerbaijan. In April 2007, he was sentenced to 11 years of imprisonment.
