Biyakai Magomedov: Orkhan Djemal's article about murder of Khadjimurad Kamalov contains personal opinion

On April 24, the Simonovo District Court of Moscow started to consider the claim on protection of honour and dignity filed by Shamil Isaev, a deputy of the National Assembly of Dagestan, against journalist Orkhan Djemal.

The deputy demands to refute the data contained in the Orkhan Djemal's article on the investigation into the murder of Dagestani journalist Khadjimurad Kamalov. In his objections to the claim, advocate Biyakai Magomedov, who represents the defendant's interests, has stated that the disputed article contains the value judgments of the author and that the right to speak them out is provided by the Russian Constitution.

Let us remind you that Khadjimurad Kamalov, a founder of the weekly newspaper "Chernovik" (Draft), was killed in December 2011 in Makhachkala. On June 20, 2013, the website "Caucasian Policy" published the article written by Orkhan Djemal. Basing on operational materials, the article has assumed that the murder of Khadjimurad Kamalov involves Shamil Isaev, a deputy of the National Assembly of Dagestan.

In late August, the deputy has filed a claim to the Golovino Court of Moscow, at the Orkhan Djemal's place of residence. However, the claim to jurisdiction was sent to the Simonovo District Court of Moscow at the defendant's new place of residence.
