BCA dismissed journalist Mirkadirov's complaint about non-admission of notary

The Baku Court of Appeal (BCA) has dismissed the appeal lodged by the Azerbaijani journalist Rauf Mirkadirov against the denial to meet a notary. The journalist wanted to notarize a power of attorney granted to a foreign lawyer to represent his interests in Turkey. Now, Mirkadirov's defence intends to complain to the European Court of Human Rights (ECtHR).

The "Caucasian Knot" has reported that Mirkadirov was detained on April 18 in Turkey and deported to Baku. On April 21, a Baku court sanctioned his arrest for three months on charges of treason.

The defence believes that Mirkadirov's rights were violated at deportation; and he actually extradited. On May 29, investigator Ibragim Lemberansky refused to admit a notary to Mirkadirov, arguing that "the secrecy of inquiry might be violated."

The appeal complaint was considered at the BCA under the chairmanship of Judge Djamal Ramazanov.

"Earlier, these particular judges rejected Mirkadirov's complaint against his unjustified arrest, while committing gross procedural violations. They could not be impartial, because they had once violated the journalist's rights," said the lawyer Suleimanov.

Azerbaijani courts have already rejected Mirkadirov's complaints on the ban to be visited by his relatives and to get subscribed to the press.
