Court rejects Sochi Mayoralty's lawsuit on demolition of apartment block built next to land plot of pensioner Dubovaya

The court in Sochi has dismissed the claim of the Mayoralty asking to recognize the construction of the building illegal and demolish the unfinished structure built near the land plot of pensioner Nina Dubovaya. At the same time, the court has satisfied the counterclaim lodged by the developer for recognition of his right for the unauthorized structure. The pensioner Dubovaya was denied participation in the case as a third party, the "Caucasian Knot" correspondent reports.

The pensioner herself believes that the judge had deliberately denied her participation, in order to indicate in her decision that "the construction of the multi-story building does not violate any third parties' rights," she said.

According to Dubovaya, she appealed to the Chairman of the Regional Court and the Investigating Committee of the Russian Federation (ICRF) arguing that the decision of legitimize the five-storey building and her non-admission to the trial had violated her rights.

"The apartment block violates the rights of the neighbours; it may be dangerous from the seismic standpoint; and there is no place for car parking and communications are required by the law for apartment houses," said the Mayoralty representative. However, the judge dismissed the Mayoralty's claim.

Ms Dubovaya announced her intention to appeal against the court ruling not to admit her to the trial.
