Advocates treat Aliev's arrest as ECHR violation
The defence does not agree with the decision of the Baku Court of Appeal (BCA), which left in custody Mekhman Aliev, the director of the Turan news agency. Advocates announced the intention to file a complaint against the Mekhman Aliev's arrest to the European Court of Human Rights (ECtHR).
The "Caucasian Knot" has reported that Mekhman Aliev was detained on August 24. The court arrested Mekhman Aliev for three months. The defence appealed against the court's decision, but on August 30, the Baku Court of Appeal dismissed the complaint.
The director of the Turan news agency is charged under Article 192.2.2 (illegal entrepreneurship with large-scale income), Article 213.1 (tax evasion), and Article 308.1 (abuse of power) of the Azerbaijani Criminal Code.
Fariz Namazly, an advocate of Mekhman Aliev, has called the BCA's decision unjustified.
"The defence party presented arguments in support of falsification of the charges against Mekhman Aliev. The figures on non-payment of taxes and illegal proceeds are not supported by concrete justifications. Unfortunately, the judges did not take into account our arguments," Fariz Namazly told the "Caucasian Knot" correspondent on August 30.
The advocate has stated that the domestic mechanisms to challenge his client's arrest have been exhausted. He has also announced the intention to file a complaint against the decision on arrest to the ECtHR.
"We will raise the issue of violation of Article 5 of the European Convention on Human Rights (ECHR), which guarantees the right to liberty and security of person," the advocate stated.
