Makhachkala resident demands compensation for unlawful criminal prosecution

Zainulabidin Mirzabekov spent 12 years proving that the charge of selling heroin brought against him was falsified, and he spent eight years in custody. The man requests court to oblige the state to pay 414 million roubles in compensation for unlawful criminal prosecution.

Advocate Vitaly Burkin reported in his Telegram channel about the unlawful criminal prosecution of Zainulabidin Mirzabekov.

“From 2010 to 2022, Zainulabidin Mirzabekov had been proving that the drug trafficking charges against him were falsified. He spent eight years in isolation from society, the verdict even came into force, and the man who was not guilty spent several months in a penal colony ... Only during the fourth court hearing, in 2021, his case was considered by adequate judges who recognized that the entire body of evidence submitted by public prosecutors was absurd, as the test purchase of a narcotic drug was primitively falsified. Since 2018, Zainulabidin Mirzabekov has been free, but the acquittal did not come into force until 2022,” advocate Vitaly Burkin reported.

Zainulabidin Mirzabekov stated that he was accused of selling 178 grams of heroin. There were many inconsistencies in the criminal case.

The man has noted that two of the law enforcers who were investigating his case still work at the police.

Zainulabidin Mirzabekov has emphasized that it was very difficult for him to fight injustice. The man intends to go all the way to recover material damages from the state for the years he spent under investigation and in the penal colony.

In December 2023, a court upheld the verdict against Makhachkala resident Shamil Idrisov, sentenced to six years of imprisonment in a penal colony on the charges of possessing a grenade. The court found unconvincing the arguments that the case materials were fabricated because of the Shamil Idrisov’s refusal to cooperate with the law enforcement bodies.
